1. Acceptance of Terms

By accessing or using the RaceFinder website (racefinder.pt) or any associated services, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, you must not use the platform.

These Terms apply to all users of the platform, including athletes, event organizers, visitors, and any third party accessing the service.

2. Definitions

For the purposes of these Terms:

  • “Platform” means the RaceFinder website, mobile interface, and all associated digital services at racefinder.pt.
  • “User” or “Athlete” means any individual who accesses the Platform to discover, save, or register for events.
  • “Organizer” means any sports club, association, municipality, or entity that lists an event on the Platform.
  • “Event” means any endurance sports race or activity listed on the Platform.
  • “Direct Booking” means the feature allowing Athletes to register for select Events directly through RaceFinder.
  • “Content” means all text, images, data, listings, blog posts, and other material published on the Platform.

3. Nature of the Platform — Intermediary Status

RaceFinder is a discovery and registration platform that acts as an intermediary between Athletes and Organizers. RaceFinder is not itself an event organizer, promoter, or sports federation.

RaceFinder does not organize, supervise, manage, or take responsibility for the events listed on the Platform. The Organizer of each event bears sole responsibility for:

  • The accuracy of event information (dates, distances, routes, safety measures);
  • The organization and safety of the event;
  • Registration management, participation conditions, and race-day logistics;
  • Cancellations, postponements, refunds, and any other changes to the event.

Where RaceFinder facilitates Direct Booking, it does so as a payment and registration intermediary only. The contractual relationship for participation is between the Athlete and the Organizer.

4. User Registration & Accounts

Certain features of the Platform require the creation of a user account. By creating an account, you agree that:

  • All information provided is accurate, current, and complete;
  • You are at least 13 years of age (or the age of digital consent applicable in your country);
  • You are responsible for maintaining the confidentiality of your login credentials;
  • You will notify RaceFinder immediately if you suspect unauthorized use of your account;
  • One person may hold only one account. Account sharing is not permitted.

RaceFinder reserves the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in abusive behavior on the Platform.

5. Organizer Listings

5.1 Listing Approval

Event listings are reviewed and approved by RaceFinder within 24 hours of submission. RaceFinder reserves the right to decline, edit, or remove any listing at its sole discretion.

5.2 Organizer Responsibilities

Organizers who list events on the Platform warrant that:

  • All event information submitted is accurate, truthful, and up to date;
  • They hold all necessary permits, licences, and insurance to organize the event;
  • They will promptly notify RaceFinder of any changes to event details (date, location, cancellation);
  • The event complies with all applicable Portuguese and EU law.

5.3 Indemnification by Organizer

Organizers agree to indemnify, defend, and hold harmless RaceFinder LDA, its directors, employees, and partners from any claims, damages, or losses arising from: (a) inaccurate event information; (b) event cancellation or modification; (c) injuries or incidents during the event; or (d) any breach of these Terms by the Organizer.

6. Direct Booking

6.1 Payment Processing

Payments are processed via third-party payment processors. RaceFinder does not store full payment card data. By completing a booking, you authorize RaceFinder to transmit your payment details to the relevant processor.

6.2 Booking Confirmation

A booking is confirmed when the Athlete receives a written confirmation from RaceFinder. This confirmation does not guarantee entry into the event if the Organizer’s capacity is subsequently reached or the event is cancelled.

6.3 Cancellations & Refunds

Cancellation and refund policies are set by the individual Organizer. RaceFinder is not liable for the Organizer’s failure to process refunds, but will use reasonable efforts to facilitate communication between Athletes and Organizers in the event of a dispute.

6.4 Service Fee

RaceFinder may charge a service fee on Direct Bookings. This fee will be clearly disclosed before payment is completed and is non-refundable once the booking is confirmed, except where required by law.

7. Prohibited Uses

You agree not to use the Platform to:

  • Post false, misleading, or fraudulent event listings;
  • Scrape, harvest, or extract data from the Platform without prior written consent;
  • Circumvent any access controls, security features, or authentication systems;
  • Use the Platform for spam, unsolicited communications, or commercial solicitation not approved by RaceFinder;
  • Impersonate any person or organization;
  • Violate any applicable law or regulation;
  • Upload or transmit malware, viruses, or any harmful code;
  • Use the Platform in any way that interferes with its normal operation.

8. Intellectual Property

All content on the Platform — including text, graphics, logos, blog posts, race data, and software — is the property of RaceFinder LDA or its licensors and is protected under Portuguese and international copyright law.

Event organizers grant RaceFinder a non-exclusive, royalty-free, worldwide licence to display, reproduce, and promote event-related content (including event names, logos, descriptions, and images) for the purpose of operating and promoting the Platform.

Users may not reproduce, redistribute, or commercially exploit any Platform content without prior written permission from RaceFinder.

9. Limitation of Liability

To the maximum extent permitted by applicable law, RaceFinder LDA shall not be liable for:

  • Any personal injury, death, or property damage arising from participation in any event listed on the Platform;
  • Any loss or damage arising from event cancellation, postponement, or modification by an Organizer;
  • Any inaccuracies in event information supplied by Organizers;
  • Any indirect, incidental, special, or consequential loss or damage;
  • Any interruption, suspension, or termination of Platform services.

RaceFinder’s total liability to any user for direct losses shall not exceed the amount paid by that user to RaceFinder in the 12 months preceding the claim, or EUR 100, whichever is greater.

10. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind. RaceFinder does not warrant that the Platform will be uninterrupted or error-free, that event listings are complete or entirely accurate, or that the Platform is suitable for your specific needs.

11. Third-Party Links & Services

The Platform may contain links to third-party websites, registration platforms, or payment processors. RaceFinder does not control and is not responsible for the content, privacy practices, or services of those third parties. Accessing a third-party site is at your own risk.

12. Cookies and Privacy

Use of the Platform is subject to our Privacy Policy and Cookie Policy, available at racefinder.pt. By using the Platform, you confirm that you have read and accept these policies.

13. Modifications to the Platform & Terms

RaceFinder reserves the right to modify, suspend, or discontinue the Platform or any feature at any time. RaceFinder may update these Terms at any time. When material changes are made, registered users will be notified by email at least 14 days before the changes take effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Portugal. Any disputes arising from or relating to these Terms shall be subject to the jurisdiction of the competent courts in Portugal.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions will continue in full force and effect.
